Lucknow, Feb 22: Congress general secretary Rahul Gandhi who is the flag bearer of party in UP election can approach the Allahabad High Court for quashing the FIR registered against him and his party workers in Kanpur on Monday for violating section 144 of the CrPC by bringing out a road show.
Congress general secretary and Uttar Pradesh in-charge Digivijay Singh said in Kanpur today the congress is considering moving the High Court against the FIR.
''There was no violation of the law during the road show as Mr Gandhi did not come out of the bus or address any election meetings en route,'' he said.
Kanpur DM Hari Om had said the FIR had been lodged at Cantonment police station under section 188, 283 and 290 of the IPC in connection with the violation of CrPC section 144.
He further said the case had been registered under above section against Rahul Gandhi and road show organizers, including Mr Mahesh Dixit.
DM also said that the road show was a clear violation of the model code of conduct and section 144 of the CrPC as they went round the city without prior permission.
The tussle arose after the Congress party demand for a 35 km road show was cut down to 20 km by the district administration because of Shivaratri festival.
''The road show was permitted from circuit house while the Congress started it from Ahirwa, thus violating the permission given by the district authorities,'' he added.
